Terms of Service

Draft — review with qualified counsel before publishing. This document states PubSentry's intended commercial terms in plain language so a lawyer can turn it into a binding contract. These Terms of Service ("Terms") govern your access to and use of the PubSentry service, dashboard, detection tag, and website (together, the "Service") provided by [LEGAL ENTITY NAME] ("PubSentry," "we," "us"). By creating an account, installing the tag, or otherwise using the Service, you ("you," the "Customer") agree to these Terms. If you are agreeing on behalf of a company, you represent that you have authority to bind it.

1. The Service

PubSentry is a real-time invalid-traffic (IVT) and ad-fraud detection product. You install a JavaScript tag on your site; the tag sends scoring beacons to our ingest service, which enriches, scores, and persists each event, and the dashboard turns that data into analytics, configuration controls, and narrated insights. The Service is provided on a best-effort detection basis. We do not guarantee that any particular fraudulent or invalid visitor will be detected or blocked, and we make no representation that detection is 100% accurate — sophisticated traffic indistinguishable from a real human is, by design, not blocked, because blocking real humans is the worse failure. You remain responsible for compliance with your own ad networks' policies.

2. Accounts

To use most of the Service you must create an account. You agree to provide accurate information, keep your credentials confidential, and be responsible for all activity under your account. Passwords are stored only as a one-way scrypt hash and sessions are cookie-based, but account security on your end (strong passwords, protecting devices) is your responsibility. Notify us promptly at [DPO/CONTACT EMAIL] if you suspect unauthorized use. You must be of legal age to form a binding contract in [GOVERNING JURISDICTION] and must not be barred from receiving the Service under applicable law.

3. Acceptable use

You agree not to, and not to permit any third party to:

  • Install the tag on a site or property you do not own or are not authorized to operate;
  • Use the Service to manufacture, launder, or inflate traffic, or otherwise to facilitate the very ad fraud the Service is meant to prevent;
  • Use detection output to evade, defeat, or reverse-engineer another party's fraud controls;
  • Misrepresent PubSentry's verdicts or statistics to your ad networks, partners, or auditors;
  • Reverse-engineer, decompile, or attempt to extract source from the tag, scoring engine, or other non-open components except to the extent that restriction is prohibited by law;
  • Probe, scan, or test the security of the Service, or attempt to access endpoints, accounts, or data that are not yours — including the backend services bound to localhost behind our reverse proxy;
  • Exceed, circumvent, or tamper with the volume limits, rate limits, or paywall of your plan;
  • Upload or transmit unlawful, infringing, or malicious content through the Service;
  • Resell, sublicense, or provide the Service to third parties except as expressly permitted in writing.

We may suspend access without prior notice where we reasonably believe continued use threatens the security, integrity, or lawful operation of the Service, ourselves, or other customers.

4. Plans, billing, and limits

Plans

Every account starts on the free plan, which includes 500 lifetime pageviews of processing. This is not a time-limited trial — it is a volume allowance. Once exhausted, data screens in the dashboard are paywalled until you purchase a paid plan; billing and account screens remain reachable. Paid plans (Starter, Growth, Scale, and Enterprise) differ from one another and from free only by volume — pageview allowance, number of sites, and history-retention window. All product detection features are available on every plan, including free. The sole feature-level distinction is the Enterprise contractual set (such as SSO, a SOC 2 / DPA package, data-residency commitments, SLA, and priority support), governed by a separate order or agreement.

Billing through DodoPayments

Paid plans are processed by DodoPayments, our merchant of record. When you subscribe you are redirected to DodoPayments' hosted checkout; we never receive or store your card details. Your purchase is also subject to DodoPayments' own terms. Subscriptions renew automatically for successive billing periods at the then-current price until cancelled; you authorize those recurring charges until you cancel.

Changes, taxes, and overages

We may change plan pricing or composition on a going-forward basis, with reasonable notice of material price increases before they apply to your next renewal. Fees are exclusive of taxes, which you are responsible for unless we are legally required to collect them. As to limits: site count and history window are enforced, free-plan pageviews are a hard gate (data screens paywall on overage), and paid-plan pageview overage is a warning, not an automatic lockout — though it may prompt an upgrade.

Cancellation and refunds

You may cancel at any time through the billing portal; cancellation stops future renewals and takes effect at the end of the current paid period. Except where required by law, fees already paid are non-refundable and we do not prorate partial periods. [Confirm refund and cooling-off obligations for [GOVERNING JURISDICTION] with counsel.]

5. Your data and the detection tag

Our handling of personal data — including the design choice to hash raw IP and User-Agent with HMAC-SHA256 and then drop them, never storing them raw — is described in our Privacy Policy, incorporated into these Terms. For visitor signals processed through the tag, you are the data controller and PubSentry is the processor acting on your instructions; you are responsible for having a lawful basis and the necessary notices and consents on your own site for deploying the tag. You retain ownership of your account data and scored event data, subject to your plan's retention window, and grant us the rights necessary to process that data to provide, secure, and improve the Service.

6. Uptime and availability — no warranty

We work to keep the Service available, but unless a separate written SLA applies to your plan (Enterprise), the Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory — including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the Service will be uninterrupted, timely, secure, or error-free. We do not warrant any specific detection rate, false-positive rate, revenue protection, or ad-network outcome. Detection and blocking decisions are best-effort and may produce both missed invalid traffic and, rarely, blocked legitimate traffic; you are responsible for verifying results before relying on them for any ad-network decision. The Service is designed to fail open — if it cannot reach a verdict, an ad is allowed to serve — and you accept that design.

7. Limitation of liability

To the maximum extent permitted by law:

  • Neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost ad income, lost data, or goodwill, even if advised of the possibility.
  • PubSentry's total aggregate liability arising out of or relating to the Service or these Terms will not exceed the amounts you actually paid to us for the Service in the [TWELVE (12)] months immediately preceding the event giving rise to the claim (or [a nominal amount, e.g. USD 100] if you are on the free plan and have paid nothing).
  • Nothing in these Terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation).

These limitations reflect the allocation of risk between the parties and apply even if a limited remedy fails its essential purpose.

8. Indemnification

You agree to indemnify and hold harmless PubSentry and its officers, employees, and agents from claims, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your breach of these Terms, your violation of any law or third-party right, your content, or your failure to obtain the consents and notices required to deploy the tag on your sites.

9. Term and termination

These Terms apply for as long as you use the Service. You may stop using it and close your account at any time. We may suspend or terminate your access: (a) if you materially breach these Terms (including acceptable use) and, where curable, do not cure within a reasonable period after notice; (b) if required by law or by a payment, ad-network, or infrastructure provider; or (c) for non-payment. On termination, your right to use the Service ends, data access stops, and your data is retained or deleted per the retention windows and the Privacy Policy. Sections that by their nature should survive — payment obligations accrued before termination, acceptable use, disclaimers, limitation of liability, indemnification, and governing law — survive termination.

10. Changes to these Terms

We may update these Terms as the Service and our providers evolve. Material changes will be reflected by a new effective date and, where appropriate, advance notice to account-holders. Continued use after changes take effect constitutes acceptance. If you do not agree to a change, your remedy is to stop using the Service and cancel.

11. Governing law and disputes

These Terms are governed by the laws of [GOVERNING JURISDICTION], without regard to conflict-of-law rules. The parties submit to the exclusive jurisdiction of the courts of [GOVERNING JURISDICTION] for any dispute, except where applicable law gives a consumer the right to bring proceedings in their own country. 12. General

These Terms, together with the Privacy Policy and any plan-specific order or DPA, are the entire agreement between you and PubSentry regarding the Service and supersede prior understandings. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
